2016 NEW ORLEANS SAINTS SEASON TICKET HOLDER ROAD TRIP SWEEPSTAKES
OFFICIAL RULES
NO PURCHASE NECESSARY. A PURCHASE DOES NOT INCREASE YOUR CHANCES OF WINNING. OPEN ONLY TO LEGAL U.S. RESIDENTS OF THE FIFTY UNITED STATES OR THE DISTRICT OF COLUMBIA, EXCEPT ALASKA AND HAWAII, WHO ARE 18 YEARS OF AGE OR OLDER OR AGE OF MAJORITY AT TIME OF ENTRY. VOID WHEREVER TAXED, PROHIBITED OR RESTRICTED BY LAW. The 2016 New Orleans Saints Season Ticket Holder Road Trip Sweepstakes (the "Sweepstakes") begins on or about 10:00 a.m. Eastern Time (ET), October 10, 2016 and ends at 10:00 a.m. ET, October 27, 2016 (the "Sweepstakes Period"). Sponsor's clock shall be the official clock of the Sweepstakes. The Sweepstakes shall be governed solely by United States federal, state and local laws.
ELIGIBILITY: The Sweepstakes is open to legal residents of the 50 United States, or the District of Columbia, except Alaska or Hawaii, who are at least 18 years of age or the age of majority in their state of residence at the time of Sweepstakes entry, who are a New Orleans Saints season ticket holder as of October 7, 2016 and who have received an exclusive offer e-mail. Employees, officers, directors and agents of United Airlines, Inc. ("Sponsor") and the National Football League, its member professional football clubs, NFL Ventures, Inc., NFL Ventures, L.P., NFL Properties LLC, NFL Enterprises LLC and each of their respective subsidiaries, affiliates, shareholders, officers, directors, agents, representatives and employees (collectively, the "NFL Entities) and their respective subsidiaries; media partners; printers; advertising and promotion agencies; their respective parent, subsidiary and affiliated companies ("Sweepstakes Entities"); and their immediate family members (including spouse, mother, father, sister, brother and children and spouse of any of the foregoing) and those living in the same household of each (people who have shared the same residence at least three months over a period of one year prior to the start of the Sweepstakes Period) are not eligible to participate or win. The NFL Entities have not offered or sponsored this sweepstakes in any way.
HOW TO ENTER: During the Sweepstakes Period, enter by clicking the "Enter" button on the exclusive offer e-mail distributed to season ticket holders and accurately complete and submit the registration form. Incomplete or illegible entries will not be considered. All entries become the exclusive property of the Sponsor and will not be acknowledged or returned, and no correspondence will be entered into. Participants will be required to indicate their agreement with these Official Rules in order to complete their Entry. Limit one Entry per person per email address during the Sweepstakes Period. Any attempt by an entrant to obtain more than the stated number of Entries by using multiple/different email addresses, identities, registrations and/or logins, or any other methods will void that entrant's Entry and that entrant may be disqualified. Use of any other automated system to participate is prohibited and will result in disqualification. Sponsor must receive all Entries by 10:00 a.m. ET on October 27, 2016. Sweepstakes entries subject to verification and compliance with these Official Rules.
WINNING: One (1) Prize will be available. On or about 12:00 p.m. (noon) ET on October 28, 2016, one potential Prize Winner will be selected via random drawing, conducted by independent judges, from among all eligible entries received during the Sweepstakes Period. Potential prize winner must meet all eligibility requirements set forth in these Official Rules to qualify for a prize.
ODDS: Odds of winning the Grand Prize depend upon the total number of eligible Entries received during the Sweepstakes Period.
PRIZE: One (1) prize: Four (4) United Airlines coach cabin round trip airline tickets for departure on Wednesday, November 16, 2016 and returning Friday, November 18, 2016 from a major U.S. gateway nearest winner's home (determined by Sponsor in its sole discretion) to Charlotte, NC. Prize is limited to flights operated by United Airlines and United Express, where United seats are sold. Prize does not include interline or codeshare flights that involve other airlines. United will select the flight times for travel in its sole discretion. Flight changes by winner are not allowed once travel is confirmed and ticketed; two-night hotel accommodations in two rooms at a hotel designated by Sponsor. Hotel accommodations will be double occupancy and includes room and tax;* *and four (4) pre-game sideline passes and four (4) tickets to the New Orleans Saints vs. Carolina Panthers game currently scheduled to be played on Thursday, November 17, 2016 at 8:25 p.m. ET. Approximate Retail Value ("ARV"): $3,200.
Winner and guests are solely responsible for any costs or expenses associated with prize acceptance and use not specified above as part of prize description, including without limitation, ground transportation, additional air transportation and accommodations, meals, tips, gratuities, beverages, sightseeing, souvenirs, excursions, baggage fees, incidentals, and personal items. Winner and guests are solely responsible for all required travel documents and/or identification (e.g., a valid government-issued photo ID, valid passport (not included in Prize). Winner and guests are solely responsible for obtaining any travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Once the winner's guests' names are communicated to the Sweepstakes administrator, those guests may not be changed or substituted, except in Sponsor's sole and absolute discretion. Winner and their guests must travel together on the same itinerary. Guests (or their parents/legal guardians, if applicable) may be required to execute Publicity Releases and/or Liability Waivers prior to and as a condition of accompanying winner on any Grand Prize. Winner's guests must have reached the age of majority in applicable state of residence unless the corresponding winner is his/her parent or legal guardian. Any allowed minor guests must be accompanied at all times during Grand Prize trip by minor's parent or legal guardian. Grand Prize winner must accept prize as described in these Official Rules. If Grand Prize winner is not willing or able to accept prize as described, the Sponsor may, in its discretion, disqualify that winner and award the prize to an alternate winner in accordance with the disqualification provisions below. Grand Prize must be completed within one year from date issued or it will be forfeited. Flights are subject to availability and reservations are required. Blackout dates and holiday exclusions may apply. Airline tickets are non-refundable/non-transferable and are not valid for frequent flyer miles. All airline tickets are subject to flight variation, work stoppages, and schedule or route changes. Lost, stolen or damaged airline tickets, travel vouchers or certificates will not be replaced or exchanged. Sponsor shall not be responsible for any flight cancellations, delays or diversions. Sponsor is not responsible if any portion of an Event is delayed, postponed or cancelled for any reason, in whole or in part. In the Event of such delay, postponement or cancellation, Sponsor reserves the right to cancel the corresponding Sweepstakes entry opportunity. Sponsor shall post notice of such action at www.neworleanssaints.com. Winner and guests agree to comply with all ticketback language and venue policies and rules.
CLAIMING PRIZES: Sponsor will attempt to notify potential Prize winner via phone and/or overnight mail using the information provided at the time of registration approximately 1 business day from the date of the drawing. Prize Winner must complete, sign and return the Affidavit of Eligibility, Waiver of Liability and, except where prohibited by law, Publicity Release Forms within 3 business days of receipt of prize notification or prize may be forfeited (TN residents need not sign the publicity releases). Properly claimed prize will be awarded, but in no event will more than one (1) prize be awarded as provided for in these Official Rules. Unclaimed prize will not be awarded. By participating in the Sweepstakes, entrants (except where prohibited by law) consent to use of name, likeness or biographical information in advertising, promotional or marketing materials without notice or compensation. In the event of noncompliance with these Official Rules, if prize notification or attempted notification is returned as undeliverable, winner cannot be contacted/does respond within a reasonable time (as determined in Sponsor's sole discretion) or a prize winner declines prize offered, prize will be forfeited, and an alternate winner may be chosen by Sponsor if time permits. By participating in the Sweepstakes, all entrants acknowledge compliance with and agree to be bound by these Official Rules and the decisions of Sponsor and/or judges, which are final in all respects. The potential prize winner must meet all eligibility requirements set forth in these Official Rules to be eligible to receive prize.
CONDITIONS: All Entries become the property of Sponsor. No correspondence shall be entered into other than the communications outlined herein. Sponsor is not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected Entries, which will be disqualified. In the event of a dispute about the identity of an entrant, entries will be declared made by the Authorized Account Holder of the email address used at time of entry. An "Authorized Account Holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. A potential winner may be required to provide Sponsor with proof that the potential winner is the Authorized Account Holder of the email address associated with the winning entry. Persons found tampering (or attempting to tamper) with or abusing any aspect of the Sweepstakes, or whom Sponsor believes to be causing malfunction, error, disruption or damage will be disqualified. Sponsor, any of its respective subsidiaries; media partners; printers; advertising and promotion agencies; their respective parent, subsidiary and affiliated companies are not responsible for any: (a) mobile device, computer, printer, hardware, software or programming malfunctions or errors or interrupted or unavailable network, server or other connections, network malfunction, or other technical failures or errors, or failure to properly process Entries; (b) communication disruption or other forces beyond the reasonable control of the Sponsor, including inability to access the registration page, submit Entries, or other disruption related to Internet traffic, virus, bug or non-authorized intervention; (c) damage caused by computer virus or otherwise resulting to any computer or mobile device from entrant's access of the registration page, whether human, mechanical or electronic; or (d) incorrect or inaccurate information, whether caused by the entrants or by any of the programming or equipment associated with or used in the Sweepstakes. By participating in the Sweepstakes, all participants acknowledge compliance with and agree to be bound by these Official Rules, the decisions of Sponsor and/or independent judges, which are final, binding and conclusive in all respects. Prize cannot be transferred, assigned or redeemed for cash.
If, for any reason, the Sweepstakes (or any element thereof) is not capable of running as planned by reason of technical issues or failures, including but not limited to, corruption of the database of entrants, tampering, unauthorized intervention, fraud, force majeure, act of God, or any other failures which Sponsor deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to modify, suspend or terminate the Sweepstakes. Any un-awarded prize remaining at the time of termination shall be awarded to an eligible non-winning participant selected by random drawing conducted by independent judges from among all eligible non-winning Entries unaffected by the failure(s) and received prior to the action. Sponsor shall post notice of such action at www.neworleanssaints.com.
LIMITATIONS OF LIABILITY: The Sweepstakes is subject to all applicable federal, state and local laws and regulations. By participating in this Sweepstakes, participants hereby waive and release and agree to hold harmless, Sponsor, NFL Entities, and Sweepstakes Entities, the United States Olympic Committee, their respective parent, subsidiary and affiliated companies, officers, directors, and agents from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and/or property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of any prize, or their participation in this Sweepstakes, or any prize-related activity.
All federal, state, and local taxes on prizes are the responsibility solely of the winner. Acceptance of a prize constitutes permission to use winner's name and/or likeness for purposes of advertising and trade in any and all media worldwide, without limitation or further compensation, unless prohibited by law. There will be no prize substitution or cash redemption.
GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE SWEEPSTAKES SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF ILLINOIS, USA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS.
DISPUTES: As a condition of entering, participants agree (a) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (b) all causes of action arising out of connected with or relating to this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court in the state of Illinois, to which participant submits to personal jurisdiction; and (c) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern and control.
WINNER LIST: For the name of the Prize winner, send a self-addressed, stamped #10 envelope to: United Airlines 2016 NEW ORLEANS SAINTS SEASON TICKET HOLDER ROAD TRIP SWEEPSTAKES Winner List Request, C/O Momentum Worldwide, 444 N. Michigan Ave., Suite 1700, Chicago, IL 60611. Winner Lists will be sent when the Sweepstakes Period is over and the properly claimed Prize have been awarded. Requests for Winner Lists must be received by December 31, 2016.
